1. General information

(1) Introduction

The protection of your personal rights during the processing of personal data is of the utmost concern to companies in the MAN Group (hereinafter referred to as “MAN”). We process personal data in compliance with the provisions of the European General Data Protection Regulation (GDPR) and in accordance with the legal regulations of the country in which the body responsible for the data processing is located. 

Furthermore, MAN companies have undertaken to provide comprehensive and uniform protection of personal data through the implementation of a binding Group policy. This ensures a level of protection worldwide within MAN that is comparable to that in Germany and the European Union. 

Moreover, our employees are obliged to maintain confidentiality with regard to the handling of personal data.

2. Information about this website and the MAN Trucker’s World drivers’ club

This data privacy notice provides information about what personal data we process and how we do so whenever a user visits this webpage and/or is or would like to be a member of the MAN Trucker’s World club. 

“Personal data” means all information relating to an identified or identifiable natural person. A natural person is considered to be identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more particular characteristics that are an expression of the physical, physiological, genetic, psychological, economic, cultural or social identity of this natural person. 

The MAN Trucker’s World drivers’ club offers its members a range of services and benefits. This website is the online platform of the MAN Trucker’s World drivers’ club. It is both an administrative tool and the club’s online presence. Interested visitors to the website can benefit from information, entertainment and services related to trucks. Members of the drivers’ club who have registered online receive additional access to exclusive content via a login section.  

3. Collection of general information and anonymous usage data

When users visit our webpage, information of a general nature is collected automatically. This information includes the type of web browser and operating system used, the domain name of the user’s internet service provider, the website that the user is visiting as well as technical information on the visit (https/http method, https/http version, https/http status code, length of the data transferred) and similar. None of this information can be used to draw conclusions about the identity of the user. This data is also generated during access to every other webpage on the internet. This is therefore not a specific function of this webpage. 

Information of this kind is collected only in anonymised form and is evaluated by us statistically. The better we understand our users’ wishes, the better we can respond to their needs.

4. Collection and processing of personal data

(1) Simple navigation of the webpage

Whenever users visit our webpage, our web servers save the IP address from which they accessed the site as well as the date and time of the visit.

This data set is created by the web server to which the user’s browser is connected. This data set is then sent to the user. MAN uses cookies to make its website more user-friendly, effective and secure. Our cookies contain no information specific to a person.

(5) Data protection declaration on the use of content delivery networks on our webpages

In order to optimise the flow of data and ensure that data is transferred as quickly and reliably as possible, some plug-ins on our website use the services of content delivery networks (CDN).

From a technical perspective, information is routed between the user’s browser and our webpages via the CDN, which can then analyse the data flow between users and our webpages to detect and defend against attacks on our services, for example. Our website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics also uses cookies. These are cookies from Google itself (Google Analytics cookies) and third party provider cookies (double click cookies). The information generated by the cookies on the use of our website (including the user’s IP address) is transmitted to a Google Inc. server in the USA and saved there. Google uses this information for the purpose of evaluating use of the website on our behalf, compiling reports for us on website activity and for providing other services relating to website and internet usage, in particular functions for display advertising, such as remarketing, reports on impressions in the Google display network, the integration of double click campaign managers or Google Analytics reports on performance in accordance with demographic characteristics and interests. (7) Implementing social media services

Our webpage only embeds deactivated buttons that do not automatically establish contact with social media services, meaning that no data is passed on when our webpage is accessed. These buttons are activated only when users click on them, thus consenting to communication with Facebook, etc. 

If users decide to activate and use a social plug-in, they can obtain information beforehand from the relevant provider regarding the way they handle data and their data privacy policy.

Facebook
Facebook is a social network of Facebook Ireland Limited (Hanover Reach, 5-7 Hanover Quay, Dublin 2, Ireland). We have incorporated different Facebook functions on our webpage (such as “Like” and “Share”). Facebook functions are identified by the Facebook logo. Depending on the type of function, other functions can be added (for example, “Like”, “Recommend”). You can tell your Facebook friends and Facebook users which articles you like/recommend by using the “Like” button. If, as a Facebook user, you have added the Facebook recommendations bar to your Facebook applications, you automatically publish your reading activity on Facebook in your newsfeed and your timeline as soon as the recommendations bar on our webpage opens. On Facebook, the people that you authorised when the application was installed will then find out which of our articles you are currently reading, or which content on our webpage you are using. You can remove the individual entries as well as the application itself at any time again on Facebook. Users’ Facebook “likes” are also synchronised with the contributions and articles on our page, as long as the user is logged on to our webpage via Facebook. Through the integration of the Facebook button on our webpage, a direct connection is established by your browser or the application with the Facebook servers, and the button for the applicable Facebook function loaded from there. Users of the MAN Trucker’s World can submit trucker stories, pictures and other material via a form. This data is processed into content by the club and shared with the club community online and in print form. 

(9) Facebook fan page

The MAN Trucker’s World club has a fan page on Facebook. The posts on this page are mainly marketing content from MAN and fan materials sent to the club. Fan materials are published only with the relevant sender’s prior consent. 

MAN Trucker’s World uses the analytical tool Facebook Insights to make its offers more attractive and determine the best time to publish posts. Amongst other things, Facebook Insights collects the following information: The total number of page impressions, “like” data, page activity, interactions with posts, video views, post reach, comments, shared content, the proportion of male and female visitors and the language.

The legal basis for collecting this data is Article 6(1)(f) GDPR.

MAN processes personal data to manage membership and in order to be able to provide and constantly improve the services associated with the club. In this context, personal data is processed for various purposes as part of a range of processing activities.

An overview of the intended purpose of our processing activities is provided below:

Club members have access to exclusive content on the club’s website. Non-members can make only limited use of club services.

For example, for market analysis, trade fair appearances, webpages, events, competitions and other promotional campaigns.

Offering products and services

Processing bookings and payments
Filling in order forms, payment processes, payment options, delivery conditions, and compliance with statutory obligations, such as accounting.

Personal data is collected directly from users within the framework of their usage of the website, when registering for club membership and when using additional offers such as Facebook.

We will also disclose personal data to service providers engaged by us for the purposes of commissioned processing (e.g. for organising trade fair events, conducting customer satisfaction surveys, sending e-mail newsletters and hosting and operating CRM systems). 

Customer data and contact details are disclosed in a centralised database to ensure that data is uniform and up-to-date.

Provided the relevant user has granted consent, we can disclose customer data and contact details as well as offer and order data to third parties for member management purposes. 

If we are required to disclose personal data in order to comply with national legal requirements, e.g. for transfers to financial authorities, courts and auditors. 

In order to ensure a high level of data privacy, data privacy contracts have been concluded with all MAN and Volkswagen Group companies that receive data.

In cases in which we transfer personal data to affiliated companies or service providers outside the European Economic Area (EEA), the data is transferred only if the European Commission has confirmed that the third country provides an adequate level of data protection and other appropriate and sufficient data protection guarantees (e.g. EU standard data-protection clauses or certification under the EU-US Privacy Shield) are in place.

8. Data provision, storage and deletion

The personal data required to set up membership must be made available to the data controller. If this data is not provided, MAN cannot fulfil its legal obligations or enter into the contractual relationship.

Data associated with visits to our webpage is saved for 52 weeks, starting from the moment our webpage is first accessed.

Other personal data is saved until users deregister themselves or inform us that they would no longer like to make use of the relevant function.  

Apart from this, data is only saved if there are statutory or contractual retention obligations.

9.The rights of data subjects

In addition to the right to be informed about data concerning them and to have incorrect/incomplete data corrected, and unless prohibited by law, users have the right to have their personal data deleted or blocked as well as the right to object to the processing of such data. They also have the right to data portability. 

Because we collect and process personal data on the basis of user consent, users also have the right to revoke their consent. A revocation of consent does not affect the legality of any processing conducted on the basis of the relevant user’s consent prior to the revocation.

If, in spite of our efforts to maintain accurate and up-to-date data, incorrect information has been saved, we will correct such information when requested to do so.

In the event of complaints, users may also contact a data protection supervisory authority.

10. Links to webpages of other providers 

Our website may contain links to the websites of other providers. MAN checked any webpages directly linked to its own site at the time the links were created and was satisfied that they were free of legal violations. However, MAN has no influence of any kind on the content of linked webpages and is not able to monitor these on an ongoing basis. Therefore MAN assumes no liability for the content of linked webpages that have been modified after the links were created. This data privacy statement does not apply to the linked webpages of other providers.

In order to keep pace with the continuous development of the internet, MAN may adapt this data privacy statement at any time while adhering to the provisions of data protection law.
